professor who focuses on ethics. the other is a former law partner of brodsky. all of this testimony is focused on brodsky himself as the legal team tries to paint him as an ineffective lawyer and argues why he is the main reason or least one of the main reasons peterson deserves a new trial. >> we are facing an uphill battle today. i'm confident. i know what is on our side. >> the jury was held for two years before the trial started. they will argue that former lead attorney had a conflict of interest and that he charged a contingency fee for media appearances. they will raise the ineffective counsel issue over the decision to call kaftans divorced attorney to the stand. during the trial smith dropped a bombshell. brodsky left the

defense team in november and to this day he defends his decision to call smith to the sandstand. he does not believe petersons attorneys will be successful today and getting him in a trial. >> he will not win a retrial. i do not see that happening. not the way that they framed this motion. >> the hearing is on a break right now. if the judge denies the motion for the new trial to move immediately to the sentencing phase. + the u-s supreme court refuses today to hear an appeal from former illinois governor george ryan on his corruption conviction. ryan was found guilty in 2005 of racketeering, fraud, and other crimes that involved

kickbacks for state contracts and property leases. he was released from prison last month, and is serving the rest of his sentence at his home in kankakee. since his conviction, he has filed several legal challenges. his latest attempt dealt with the so-called "honest services" issue. joining us now is wgn legal analyst terry sullivan. his new lawyer says he deserves a new trial because his first lawyer botched the case. do you have an opinion on that? >> know.no. >> excuse me for clearing my throat. this has been used before. the problem that these guys have now is the fact that this is what is known as legal strategy. legal strategy we are

in a very imperfect science. whatever the lawyers choose to do especially if the plan goes along with that that strategy. it just because it didn't work does not mean that a court is going to overturn it. >> what the make of the suggestion that if they appealed for other reasons that they actually would be more successful? >> i think they did ask for other grounds. as we have said for years the main thing that has to go out to the appellate court. the issue of the hearsay that went into the trial. especially here say from a divorce lawyer and the rev.. that is what convicted him.

>> this season's $750,000 in campaign contributions. he could face a lengthy prison sentence. >> what goes on and is behind the scenes negotiations? >> you could also assume that probably the government has wanted him to give them more information. the question asis who has a given them information about? does it have to do with other things that he did in congress.? other congressmen? senators? who knows? they are

all he has the right to. second of all it is in on story. is a non story. >> take care of that voice. >>hot tea and honey. >>a violent accident in northwest suburban antioch takes the lives of two teenagers. their s-u-v skidded off the road and uprooted a large tree. wgn's nancy loo has more on the victims and how a community is coping with the tragedy. deadly crash here last night has hit hard at two local high schools. both teenagers were well liked. they just are debating each other earlier this month. the 16 year-old was behind the wheel of a black chevy trail blazer when it veered off wal-mart road. it

happened around 7:00 p.m.. he apparently died on impact along with his passenger. today the flags were lowered at the high school where she was a junior and crisis counselors are on hand. that is also the case over at antioch high school. >> we are grieved to have one of our students lives cut short. >> the sheriff's office says weather was a factor. it was raining heavily at the time the vehicle slam threat fence and into a tree. sending it on to the vehicle. >> i saw headlights. we saw something unusual coming by the front of the driveway. we saw the flash is coming on. we ran outside and we saw the car was in the tree. the tree was on top of the car. we checked the scene

for safety. we had flashlights. neighbors came across the street and looked inside. it did not look promising. >> it is not clear how fast the suv was going. he was on the football team at antioch high school. the team has scheduled a special meeting for after school. lawyers for the family of in northern illinois university student who does were back in court today trying to get more information for their lawsuit. the freshman died last november after drinking heavy amounts of alcohol. nearly two dozen fraternity members have been charged with hazing crimes. a judge granted the family lawyers a request for more evidence.

>> what do you think you might find? >> names and identities of other people there. jesse jackson junior's federal pension may be in jeopardy. jackson would have been eligible to collect a pension of 45- thousand dollars a year when he reached 62 years old. but the federal charges leveled against him may change all of that. an attorney tells the chicago tribune there is a law that strips pensions away from lawmakers convicted of corruption. jackson served nearly 17 years

in congress. he is expected to plead guilty to misusing campaign funds. mayor rahm emanuel and governor pat quinn announced today that a new 12 hundred room hotel will be built near mccormick place. the agency that operates mccormick place is acquiring a site adjacent to the convention center to build the new hotel. the facility will allow mccormick place to add about 15 new mid-market events each year.. generating about 80 thousand attendees. the hotel will be located between michigan and indiana along the south side of cermak. it's expected to create nearly 25 hundred construction jobs and 500 permanent local jobs. coming up next: the latest in south africa where olympic runner appeared in court today for the murder of his girlfriend. plus, investigators reveal what the sandy hook elementary school shooter's motive was.. who inspired him to open fire in that deadly shooting. and, the warning from health experts about a new mysterious sars-like virus that could affect patients here in the u.s. i remember the day my doctor said i had diabetes. there's a lot i had to do... watch my diet. stay active. start insulin... today, i learned there's something i don't have to do anymore.

who unleased the shooting spree was upsets with other mass murderers. there is evidence that the 20 year-old was consumed by anders brevet. he chose sandy hook elementary because he considered it an easy target. he shot and killed 26 people and taking his own life. mechanical issues appeared to have caused a carnival cruise ship to lose power in the gulf of mexico. more than four-thousand people were stuck on this ship, without electricity or running water for five days. the coast guard says the problem started with a leak in a fuel- oil return line that was connected to a generator. the leaking oil hit a hot surface and caught fire. the fire was contained, but the ship had to be towed to land. investigators say a full report on the ship could take up to 6 months.

met with president obama today. the white house said the president accepted his request to retire from the military so he could address health issues within his family. he was going to be nato's top commander. he was caught in the middle of a scandal over an embarrassing e- mail's. he was cleared of any wrongdoing. president obama urges congress to take quick action on the budget otherwise there will be serious consequences on the economy and government services. border patrol agents will see their hours reduced. fbi agents will be furloughed. federal prosecutors will have to close cases and let criminals go. air- traffic to trollerscontrollers will seek cutbacks. more delays across the country. law >> makers need to strike a deal by march 1st. democrats are

they are snowing on lower michigan if . that is interesting. there is a huge storm. what that means is that the air is rising so quickly into that system that the air around it floods in to replace the rising air. you get all of this land. it turns into a giant wind machine. put that with 35 agreedto recall their temperatures. the windchill went subzero for the first time around 6:50 a.m.. it has not recovered since then. flurries are on the way for today. these will not be terribly important. i guess it looks kind of dramatic at times but except for some slippery spots it is not a big deal. we get through

tonight tamara and even thursday without any snow. there is tonight a weakening storm. and may turn out to be one of the winter's most respectable snows. 33 degrees colder than 24 hours ago. many of our neighbors are in the same boat. it is this art daguerre spilling all the way south of the gulf.arctic air. up here in great falls there at a below zero. a look at the expense of the cois chilly. we are doing this with a lot of wind. these are wind gust going across the midwest. our local wind gust are

kind of impressive. 29 at midway. interesting. we looked at the lowest windchill and highest wind gust as our key observation stations. ohare has been at 5 below. west chicago the same thing. wheeling has had 43 mi. an hour wind gusts. what is uniform across the area is the fact that if you take these temperatures and put them with the wind you have a subzero wind chill. the wind is west at 22. humidity at 71%. the dew point is just six. here is storm one and there is storm to. we're just trying to get clouds to develop. the light the fact snow is pretty evident on radar. following and the usual areas.

we are not expecting huge amounts of snow here. while there are advisory's for that lakes and the snow windchill advisor him no.. here's a result of that storm lifting into the plains. winter storm watches and these yellow areas. a patchwork of advisory's out to the west. here's what happens. a jet stream coming in from the north. look at how on friday morning we will sit right on the nose of that jet. that is during rush hour. friday morning as saying goodbye to this first and storm. here is where it will be snow white and the day thursday. it

comes and thursday night. the storm will be in a weakening phase at that point. it still could kick out a respectable snow. here's a little closer look at the store and go and buy and the precipitation and area. kansas and nebraska appear to be at the epicenter. you'll see how this no lives through the area. it starts here at about 2:00 a.m. friday morning. look at some of the numbers. these numbers out in nebraska and kansas, 17.3 in.. 14.3 in. at grand island nebraska. we will just tell our area here. some of the numbers we're getting right now. these are preliminary. one models take the much not my fault. that model says 4.6 in.. the average when you look at all of the models comes to about 4 in.. add 2 in. on either side

on the medical watch a new sars-like virus that's killed five people so far could potentially be treated with drugs that boost the immune system. the "novel coronavirus".. or n- c-o-v.. was identified just last september. its symptoms include severe respiratory illness, fever coughing, and breathing difficulties. so far, it's only showed up in europe and the middle east but experts say they would not be surprised if it appears in the u-s. a new study finds the virus is well adapted to infecting the human respiratory tract, and that it's also susceptible to treatment with interferons. medicines that boost the immune system and are used successfully to treat other viral diseases like hepatitis c. acupuncture helps relieve pain in some people and now, a new study suggests it may also relieve your allergy symptoms. researchers studied more than 400 people wih pollen allergies. some took only antihistamines for their symptoms others took antihistamines with acupuncture and the rest took antihistamines along with fake acupuncture needles placed at random in non-meaningful points

i've always looked up to my brother. he doesn't look like a heart attack patient. i was teaching a martial arts class and it hit me. we get to the emergency room... and then...and then they just wheeled him away. i had to come to that realization that "wow, i am having a heart attack." i can't punch this away. i'm on a bayer aspirin regimen.
